This Privacy Policy explains how TEAM RMS, LLC and its subsidiaries and affiliated companies (“TEAM”, “we” or “us”) collects, uses, and discloses information about you when you access or use our websites (the “Websites”), contact our customer service team, or otherwise interact with us.

We may change this Privacy Policy from time to time.  If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, we may provide you with additional notice (such as adding a statement to our website homepage or sending you a notification).  We encourage you to review the Privacy Policy whenever you access the Websites or otherwise interact with us to stay informed about our information practices and the choices available to you. Website users may opt to click the link located on the homepage stated, “Do Not Sell My Information” in order to properly opt out of the sale of any personal data and information.

COLLECTION OF INFORMATION

Information You Provide to Us

We collect information you provide directly to us.  For example, we collect information when you send us a message through TEAM Websites, provide us with your business card at an event, fill out a form or survey, are referred for or apply to a job, request services or customer support, or otherwise communicate with us.  The types of information we may collect include your name, email address, postal address, phone number, account or employment related information, and any other information you choose to provide.

Information We Collect from Other Sources

We may also obtain information about you from other sources. For example, when we receive a referral for a worker for hire, we may collect information about the client/service recipient as applicable, including information about their name, address, date of birth, and nature of services requested. We may also collect information about the referred worker, such as their name, address, date of birth and other employment related information.

Additionally, if you are referred to us for employment purposes, we may collect information about you from identity verification and background check services.


USE OF INFORMATION

We use the information we collect to respond to inquiries, process job employment referral information and to provide, maintain and improve our services. We also use the information we collect to:

  • Communicate with you about products, services, and events offered by TEAM and others, and provide news and information we think will be of interest to you (see “Your Choices” below for information about how to opt out of these communications at any time);
  • Send you technical notices, updates, security alerts, and support and administrative messages and to respond to your comments, questions, and customer service requests;
  • Determine your eligibility for employment with us;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and protect the rights and property of TEAM and others;
  • Debug to identify and repair errors that impair existing intended functionality;
  • For limited internal uses, provided the personal information is not disclosed to another third party and is not used to build a profile about you or otherwise alter your experience outside the current interaction; and
  • Carry out any other purpose described to you at the time the information was collected.

SHARING OF INFORMATION

We may share information about you as follows or as otherwise described in this Privacy Policy:

  • With vendors, service providers, and consultants that perform services for us, including background check services, administering health and welfare benefits, and backup and storage of data and CRM services;
  • In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements;
  • If we believe your actions are inconsistent with our policies, if we believe you have violated the law, or to protect the rights, property, and safety of TEAM or others;
  • In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company;
  • Between and among TEAM and our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership; and
  • With your consent or at your direction.

We may also share aggregated or de-identified information that cannot reasonably be used by those third parties to identify you.


TRANSFER OF INFORMATION WITHIN THE U.S. AND OTHER COUNTRIES

TEAM is based in the United States and we process and store information in the United States.  Therefore, we and our service providers may transfer your information to, or store or access it with, equivalent levels of data protection across the United States.

Your Information

You may update and correct certain information you provide to us at any time in writing to [email protected] or by mail at 3131 Camino del Rio, N., Ste. 650, San Diego, CA 92108.  If you wish to delete your information, please email us at [email protected], but note that we may retain certain information as required by law or for legitimate business purposes.  We may also retain archived copies of information about you for a certain period of time.

Cookies

Most web browsers are set to accept cookies by default.  If you prefer, you can usually choose to set your browser to remove or reject browser cookies.  Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Services.

Promotional Communications

You may opt out of receiving promotional communications from TEAM by following the instructions in those communications or by emailing [email protected]. If you opt out, we may still send you non-promotional emails, such as those about your employment or services to an account or our ongoing business relations.


YOUR CALIFORNIA PRIVACY RIGHTS

Consumers residing in California have certain rights with respect to their personal information under the California Consumer Privacy Act or (“CCPA”) (California Civil Code Section 1798.100 et seq.) and the “Shine the Light” Law (California Civil Code Section 1798.83). If you are a California resident, this section applies to you.

Collection and Use of Personal Information: In the preceding 12 months, we have collected the following categories of personal information:

  • identifiers such as real name, alias, postal address, internet protocol address, email address, social security number, driver’s license number, passport number, or other similar identifiers
  • categories of personal information described in subdivision (e) of Section 1798.80
  • commercial information including records of services purchased
  • characteristics of protected classifications under California or federal law
  • professional or employment-related information
  • education information

We collect this information from you, third parties, or as otherwise described in this Privacy Policy. For examples of more specific information we collect and the sources of such collection, please see “Collection of Information” above. We collect personal information for the business and commercial purposes described in “Use of information”  above.

Disclosure of Personal Information: We may share your personal information with third parties as described in the “Sharing of Information” section above. In the preceding 12 months, we have disclosed the following categories of personal information for business or commercial purposes: identifiers and professional or employment-related information. TEAM does not sell the personal information of California residents collected under this policy without consent.

Your Consumer Rights

If you are a California resident, you have the right to (1) request more information about the categories and specific pieces of personal information we have collected, sold and disclosed for a business purpose in the last 12 months, (2) request deletion of your personal information, (3) opt out of the sale of your personal information, if applicable, and (4) be free from discrimination for exercising your rights under the CCPA. You may make these requests by calling 1-877-767-8728 (Toll Free) or emailing [email protected]. We will verify your request by confirming your identity and authorization to request changes. To designate an authorized agent to exercise these rights on your behalf, you must provide the authorized agent with power of attorney or written and signed permission to submit the request as well as verify your own identity directly with us, and directly confirm with us that you have provided the authorized agent with permission to submit the request.
